💰 Paying Spouse — Income Analysis

W-2 wages + bonus
⚖ ISSUE: Is the bonus counted?
Whether the bonus counts as income for support turns on its character. Pick the character below for a recommendation. Base only = $236,819 W-2; all-in = $336,819 (W-2 + $100,000 bonus). The support calculators use whichever paying-spouse card you select above.
Select one or more characters to see whether the bonus should be counted.

💰 Supported Spouse — Income Analysis

Earning capacity vs. claimed $0
Primary earned income (Helping Hearts)

Select one HH basis. Use the tax/non-tax toggle on HH cards when you need tax-equivalent comparability.

Secondary earned income (Fleet Feet)

Select one Fleet Feet basis. Primary + secondary rolls into the earned-income total card below.

Total earned income comparison

Compare the selected HH + FF total against expert/opposing/vocational positions, and choose the basis to roll to AFI, Spousal, and Child Support.

⚖ ISSUE: Earning capacity vs. claimed $0
Documented employment income is shown in the tables above. Even a conservative vocational floor supports higher earning capacity imputation. Documented employment records materially reduce spousal maintenance liability.
Imputation options (Supported Spouse):
Vocational floor: $45,480 (Taft earning capacity)
Documented: $66,086 (2026 discovery paystubs)
Run-rate: $78,169 (bank-verified deposits)

🧭 Shared income hub

AFI · Spousal · Child support
This page is the single source for the income positions, supporting exhibits, and estate/property-income context. AFI stays focused on the expense and need comparison, while spousal maintenance and child support consume these values rather than re-stating the full income narrative.

🏛 Property / Investment Income (supported spouse)

§25-319(B) return on assets

Property income is treated like any other income type — pick one basis to attribute a return on Constanza's assets (net of 25% tax). The "½ estate" options use her 50% share of the net marital estate as valued on the Asset page ↗. The selected figure rolls to Spousal & AFI automatically. Not legal advice — defer to Holly.

🎯 Imputation Methodologies

When to use each approach
1. Documented Income Approach
Use tax returns, W-2s, paystubs, 1099s as filed. Most conservative. Used when income is clearly documented and verifiable.
2. Average Historical Income
Average last 2–3 years of tax returns or pay history. Accounts for variability in bonuses, commissions, self-employment. Often used for business owners & commission-based employees.
3. Earning Capacity / Vocational Expert
Used when party is voluntarily underemployed, unemployed, or claims limited earning capacity. Expert determines what they could earn (not what they claim).
4. Business Income Analysis
For self-employed: reconstruct from profit & loss statements, bank deposits, tax returns. Adjust for add-backs (depreciation, non-recurring expenses, perks).
5. Cash Flow / Bank Deposit Analysis
When documentation is poor: analyze bank deposits to identify undisclosed income. Used when party hides self-employment or informal income streams.

📋 Recommended Imputation (This Case)

Supported by documentation
Party Conservative Recommended Aggressive
Luis $236,819
(W-2 base)
$236,819
(bonus separate)
$336,819
(+$100k bonus)
Coni $45,480
(vocational floor)
$66,086
(documented 2026)
$78,169
(run-rate)
Rationale:
Luis: Use the $236,819 W-2 base; the $100,000 bonus is contested (separate property, Memo 17) and layered in only for the aggressive case.
Coni: Impute at least her documented $66,086 (2026 paystubs) — opposing counsel's $0 is untenable against the pay records. The $45,480 vocational floor is the conservative minimum.
